Gateway 2 — Before Construction Commencement
This gateway must be passed before any construction work can begin on a higher-risk building.
Building Safety Act 2022, Section 31(3)
Gateway 2 is the most critical regulatory checkpoint in the Building Safety Act framework. Before you can begin construction on a higher-risk building (HRB), you must submit detailed design information to the Building Safety Regulator (BSR) and receive approval. The BSR will assess whether: • The design meets all relevant building regulations • Adequate fire safety measures are incorporated • You have demonstrated competence to carry out the work • You have appropriate systems to manage building safety If your submission is rejected, you cannot legally begin construction. Proceeding without Gateway 2 approval is a criminal offence under Section 35 of the Building Safety Act 2022. As the Principal Designer, you have personal legal accountability for the accuracy and completeness of this submission. False or misleading information may result in prosecution.
If Rejected
If Gateway 2 is rejected, construction cannot legally commence. You must address all deficiencies and resubmit.
Proceeding Without Approval
Beginning construction without Gateway 2 approval is a criminal offence. Directors and officers may face personal liability.
